1. Introduction and Acceptance of Terms
Welcome to R P Cyber Cafe. These Terms and Conditions ("Terms", "Agreement", or "T&C") constitute a legally binding contract between you (referred to as the "User", "Client", "Customer", or "You") and R P Cyber Cafe (referred to as the "Company", "Cafe", "We", "Us", or "Our"). This Agreement governs your access to and use of our official website www.rpcybercafe.com, our digital communication channels (including WhatsApp and Email), and all physical services, hardware usage, and technical facilitation provided at our brick-and-mortar establishment located at 8, Sashi Bhushan Ghosh Lane, Mahesh, Serampore, West Bengal.
By accessing our website, browsing our blog, booking an appointment, paying for a service, or sitting at one of our physical computer terminals, you explicitly acknowledge that you have read, comprehensively understood, and unconditionally agreed to be bound by all the stipulations contained within these Terms. 2. Definitions

"Government Portals": Any official website operated by the State Government of West Bengal, the Government of India, or authorized public sector undertakings (e.g., UIDAI, SSC, WBPSC, wbsportsandyouth.com).
"Digital Services": Includes but is not limited to online applications, ticket booking, resume generation, result checking, and digital downloading.
"Physical Services": Includes hardware usage, high-speed internet browsing, document printing, digital scanning, photocopying (Xerox), lamination, and spiral binding.
"Service Charge": The professional fee levied by R P Cyber Cafe for our time, internet bandwidth, expertise, and hardware usage. This does NOT include official government challans or exam fees.
3. Scope of Services and Nature of Business
R P Cyber Cafe operates strictly as a Private Technical Assistance and Facilitation Center. We possess expertise in internet browsing, data entry, and digital formatting.
Non-Affiliation: We are an independent, privately-owned commercial entity. We are NOT a government department, a public office, an official Common Service Centre (CSC) unless explicitly certified, nor are we directly affiliated with any university, recruitment board, or state ministry.
Facilitator Role: Our role is strictly limited to providing the hardware (computers, internet, scanners) and the technical manpower to help you interact with third-party websites. We act as your typist and technical guide based solely on the instructions and documents you provide.
4. User Eligibility and Legal Capacity
By utilizing our services, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. Minors (individuals under the age of 18) are permitted to use our services (such as applying for school scholarships or college admissions) only under the direct supervision, guidance, and explicit consent of a parent or legal guardian. The Cafe reserves the right to request valid age and identity proof before granting access to our public computer terminals.
5. User Obligations and Code of Conduct
To maintain a secure, lawful, and productive environment, all users must adhere to strict behavioral and operational guidelines.
5.1. Accuracy of Information Provided
When you engage our staff to fill out an application on your behalf, you bear the sole and absolute responsibility for the accuracy, authenticity, and legality of the data and documents you provide.
You must provide original, un-tampered documents for scanning.
You are required to physically or digitally review the "Final Preview" screen of any application to verify the spelling of names, dates of birth, addresses, and financial details before authorizing us to click the final "Submit" button.
R P Cyber Cafe shall hold absolutely zero liability for application rejections, delayed payments, missed admit cards, or legal penalties resulting from typos, incorrect data, or fraudulent documents supplied by you.
5.2. Lawful Use of Cafe Hardware
If you are renting a public terminal for personal browsing, you agree to use the internet strictly for lawful purposes. You are expressly prohibited from:
Accessing, downloading, or distributing illegal, pirated, or copyrighted material.
Viewing, storing, or transmitting pornographic, obscene, or culturally offensive content.
Engaging in hacking, unauthorized penetration testing, phishing, distributing malware/viruses, or launching Denial of Service (DoS) attacks.
Conducting any form of financial fraud, identity theft, or cyber-bullying.
Violation of these rules will result in immediate termination of your session without refund, permanent banishment from the premises, and immediate reporting to the local Serampore Police authorities under the relevant sections of the IT Act, 2000.
5.3. Aadhaar and OTP Delegation
When utilizing our services for Aadhaar-linked applications (e.g., PAN generation, PF withdrawal, Yuva Sathi), you authorize our operators to input your Aadhaar number and the resulting One-Time Passwords (OTPs) into the respective official portals. You understand that this authorization is temporary and restricted exclusively to the immediate session required to fulfill your specific service request.
6. Payment Terms, Service Charges, and Taxes
R P Cyber Cafe operates on a transparent, fee-for-service model.
Dual Cost Structure: The total amount payable by you often consists of two distinct parts: (1) The Official Government/Exam Fee (e.g., ₹100 for an SSC application), and (2) The R P Cyber Cafe Professional Service Charge (e.g., ₹50 for data entry and printing).
Payment Timing: All service charges and physical printing costs must be settled in full immediately upon completion of the service, or in advance at the management's discretion.
Payment Methods: We accept cash and UPI (Google Pay, PhonePe, Paytm, etc.). For online requests, payments must be completed via our designated secure payment gateway before the delivery of digital documents.
Taxes: All stated service charges are inclusive of applicable local taxes unless explicitly stated otherwise.
Price Variations: Prices for form filling vary based on the complexity, time required, and server speed of the respective portal. Final pricing will be communicated to you before the commencement of the service.
7. Intellectual Property Rights
All original content present on our website (www.[yourwebsite].com), including text, blog articles, graphics, logos, button icons, digital downloads, and structural layouts, is the exclusive intellectual property of R P Cyber Cafe and is protected by Indian and international copyright laws.
Blog Content: Our educational guides and scheme breakdowns are proprietary. You may not copy, reproduce, republish, or commercially exploit our blog content without obtaining prior written permission from us.
User Documents: We make no claim of ownership over the personal documents, photographs, or certificates you bring to our cafe for processing. These remain your exclusive property.
8. Third-Party Links, Portals, and Advertisements
Our website and blog frequently feature outbound hyperlinks to third-party government portals, university websites, payment gateways, and educational resources.
These links are provided purely for your convenience and navigational ease.

9. Disclaimer of Warranties
All services provided by R P Cyber Cafe, both digital and physical, are rendered on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.
No Guarantee of Success: We do not warrant, guarantee, or promise that the applications we help you submit will be approved by the governing authorities. Securing a job, gaining college admission, or receiving a government grant is solely dependent on your merit and the discretion of the reviewing officials.
Technical Uptime: We do not warrant that our website, our internet connection, or the third-party government portals we access will be uninterrupted, error-free, secure, or free from server crashes.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, under no circumstances shall R P Cyber Cafe, its owner, managers, employees, or operators be held liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with:
Your use or inability to use our services due to power failures, ISP outages, or hardware malfunctions.
Missed deadlines for jobs, exams, or schemes due to official government portal server crashes or unresponsiveness.
Financial losses, loss of employment opportunities, or loss of data resulting from application rejections caused by inaccurate data provided by you.
Unauthorized access to your data resulting from sophisticated cyber-attacks beyond our reasonable security measures.
In any event, the total aggregate liability of R P Cyber Cafe for any claim arising from our services shall not exceed the total Service Charge actually paid by you to us for that specific transaction. Government fees/challans paid to third parties are strictly excluded from our liability cap.
11. Indemnification
You agree to indemnify, defend, and hold harmless R P Cyber Cafe, its owner, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal and attorney fees) arising from:
Your violation or breach of any clause within these Terms and Conditions.
Your submission of fraudulent, forged, or legally invalid documents.
Your infringement of any third-party rights, including intellectual property or privacy rights, while using our public terminals.
Any misuse of government portals or financial networks executed from our premises.
12. Force Majeure
R P Cyber Cafe shall not be deemed in breach of this Agreement, nor liable for any failure or delay in the performance of our duties, if such delay or failure arises from events beyond our reasonable control (Force Majeure). Such events include, but are not limited to: acts of God, severe natural disasters (cyclones, floods), widespread power grid failures, catastrophic internet service provider (ISP) outages, national or state-wide strikes/bandhs, government-mandated lockdowns, riots, or the complete technical failure of external government servers (e.g., UIDAI servers being down).
13. Termination and Suspension of Services
We reserve the unilateral right to refuse service, terminate your active browsing session, or ban you from our physical premises immediately and without prior notice or refund, if:
You violate any provision of these Terms and Conditions.
You engage in abusive, threatening, or disruptive behavior toward our staff or other customers.
You attempt to process fake documents or commit digital fraud.
You refuse to provide mandatory identification for the Cyber Cafe Logbook as required by police regulations.
14. Modifications to the Terms
R P Cyber Cafe reserves the right to update, amend, or modify these Terms and Conditions at any time to reflect changes in our operational procedures, pricing policies, or legal regulatory requirements. Any such modifications will be effective immediately upon being posted on this website. Your continued use of our website or physical cafe services following the posting of revised Terms constitutes your binding acceptance of those changes.
15. Governing Law and Dispute Resolution
This Agreement, and any disputes arising out of or related to your use of R P Cyber Cafe's services, shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts located in Serampore, Hooghly District, West Bengal, India. By using our services, you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
16. Severability and Waiver
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect. The failure of R P Cyber Cafe to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future.
